Thank you for choosing to book your holiday accommodation with Forbes Stynes Real Estate. Please read & familiarise yourself with the information below to ensure your stay is enjoyable. These terms are for bookings made directly or indirectly via any third-party providers.

Forbes Stynes Real Estate PTY LTD operates under various sub-trading names which may be referred to by the below references for the remainder of this document.

Disclaimer:

Forbes Stynes Real Estate is a private real estate agency operating primarily in the Snowy-Monaro & South Coast of NSW regions. FSRE is not responsible for or bound in any way by NSW National Park operation, Kosciuszko Thredbo PTY LTD operations, Perisher Ski Resorts operations, any lift operations, seasonal activity operations, events schedule, ticket sales or any other 3rd party event or organisation. 

FSRE is not responsible for or bound in any way by NSW National Parks operations, Local Government Council or Kosciuszko Lease Holder Operation. FSRE is not responsible for or bound in any way by snow conditions, beach conditions, wind conditions, power outages, or mains water supply. 

All bookings are made & accepted on the basis that you have read, understood, and agree to abide by and be bound by this Disclaimer and the following Payment Terms, Cancelation Policy, Terms & Conditions and Guest Registration/Security Deposits information.

 

Payments Terms:

New bookings outside 60-days before arrival: 20% non-refundable deposit payable at the time of booking.

New Bookings inside 60-days before arrival: 100% deposit payable at the time of booking.

 

  • A non-refundable 20% deposit is required when booking. The deposit is required instantly when payment is made via a credit card or remittance of a bank transfer within 24 hours. 
  • If the booking is created within 60-days of arrival date, then the full amount is due at the time of booking.
  • The booking will be unconfirmed until the relevant deposit has been received. 
  • Payment of the full remaining balance is due 60-days before arrival.                                                                
  • Failure to provide the remaining balance on the due date may result in the booking being unconfirmed, cancelled, or resold. 
  • FSRE reserve the right to charge the full remaining balance to the payment method on file if due within 60-days without notification. 
  • If any additional cleaning fees, booking fees or administrative fees were payable, these are included in the total.
  • 20% deposits, 100% deposits or the 60-day remaining balance must be made in full. 
  • Partial payments, or payments above the minimum 20% deposit amount can be made at any time before the 60-day remaining balance.
  • When payment is made by direct transfer the payee must include the full name of the booking or the booking reference number in the transfer reference field and if possible, the arrival date. 
  • We use automated Emailing and SMS systems to remind you of upcoming payment dates and the final payment dates.
  • Arrival information & access will not be provided until payment is received in full.
  • The Cancellation Policy will be charged per the Cancellation Fee’s set out in the Standard Cancellation Policy.

 

Payments can be made by the following options only.

TSA, SISO, JSA & Nanook bookings accept: Visa & Mastercard (0.93% Card Surcharge), Amex (2.25% Card Surcharge) and Direct Deposit (No Surcharge).

SCHA bookings accept: Visa & Mastercard (1.10% Card Surcharge) and Direct Deposit (No Surcharge). Amex not accepted for SCHA Bookings.

Cash payments are not accepted.

 

Standard Cancellation Policy:

If cancelling your booking you are subject to the below cancellation conditions, which will vary depending on the time remaining from the cancellation until the arrival date and the conditions under the cancellation.

FSRE strongly recommends guests have their own personal travel insurance. 

Credit card fees originally paid always remain non-refundable.

Cancellations outside 60-days before arrival:

  • No refunds are issued for bookings cancelled outside of 60-days before arrival. The 20% non-refundable deposit will be withheld as the cancellation fee however no further payment of the remaining balance is required after cancellation.
  • If the original payment made was larger than the 20% non-refundable deposit required, the additional payment amount above the 20% non-refundable deposit will be refunded less any credit card fees originally paid. 

 

Cancellations inside 60-days before arrival:

  • No refunds are issued for bookings cancelled within 60-days before arrival. The amount paid to date will be withheld as the cancellation fee. 

 

NOTE: 

To become eligible for a refund, the property would need to be successfully rebooked by a new guest for the same dates. 

For these dates to become viewable by a potential new guest we do require written confirmation that you understand the above terms and you wish to proceed with the cancellation. 

Only once the booking is cancelled in our system can it be viewable by new potential bookers. 

Once this has happened, you are also able to track if the property has been successfully rebooked via the website's live booking calendar.

A refund will only be issued if the property is successfully rebooked by a new guest for the same length of stay, price, and dates as per the original booking before cancellation. No refunds are issued for partial rebooking of the original booking length and dates. If the property is rebooked successfully under the above conditions the total amount paid will be refunded less any credit card fees originally paid.

Refunds under such conditions are only actioned after the successful rebooking has been completed in full (i.e. after the original departure date before cancellation).

The above rebooking conditions apply for cancellations outside or inside 60-days before arrival.

Cancellation of a booking must be in writing and must be received by FSRE via email to the same email address you received your original confirmation. Cancellation fees will be withheld on confirmed bookings per this policy.

 

Cancellations are not accepted for changes in your personal preferences to travel or group conditions.

  • Credit Card Fees are non-refundable.
  • Refunds can only be issued back to the same payment method used originally.
  • Failure to make final payment on the payment due date may result in an automatic cancellation of the booking without notice and the Standard Cancellation Policy will apply.
  • Final balance payments cannot be delayed in attempt to force a change or variation in the conditions of the Standard Cancelation Policy
  • 20% non-refundable deposits cannot be transferred or held towards future bookings or different properties.
  • Future credits are not offered for cancellations.

 

Date Changes & Property Changes

Date changes & property changes will only be allowed when the request is made outside 60-days before the arrival date and will be subject to an additional $150.00 amendment fee being added to the total of the new booking. Any requested move less than 60 days before arrival will not be accepted and are treated as a standard cancellation per the standard cancellation policy.

 

No-Show & Non-arrivals

Refunds will not be issued or given to any booking which fails to arrive on the nominated arrival date, or any portion of the booking which is not used from an early departure or later arrival.

 


 

 

Variation to Standard Cancellation Policy

Bookings will only be eligible to receive a variation to the standard cancellation policy under one of the following conditions:

  • A Government imposed non-travel restriction within our area/region or the documented primary guests’ area/region, or
  • A Government imposed border closure, or
  • A Government-issued or certified advisory to isolate due to an infectious disease, or
  • Extreme weather events or natural disasters causing the property to be completely inaccessible for more than 48 hours, which has also been verified by a documented Government body

 

The above condition will need to be officially documented on relevant State Government Advisory sites which affect the arrival date of the booking. News headlines or press conferences will not be accepted until this information is delivered via officially documented channels.

 

If one of the above conditions is met:

The 20% non-refundable deposit will be withheld as the cancellation fee. The remaining balance will be refunded less any credit card fees originally paid.

i.e. (total payment) less (credit card fees) less (20% non-refundable deposit) equals (your refund)

Travel Insurance

FSRE strongly recommends guests have their own personal travel insurance. 

Cancellations or refunds are not accepted based on medical conditions or personal injury.

Caution and consideration need to be given to our standard cancellation policy, injury, delayed flights, illness, global pandemics, and any political uncertainty. 

The Snowy-Monaro & South Coast of NSW regions are in a dynamic environment which can experience extreme weather events in all seasons. National Park closures, beach and road closures can happen. We do not refund for such occurrences, therefore travel insurance can be another option to safeguard yourself.

 

Online Travel *Agency Bookings

(Airbnb, Booking.com, Expedia, Stayz or their affiliate sites)

Once you are booking or request to book is confirmed with the online travel *agency used, you will traditionally receive the remainder of the information via email or SMS from our regular booking system. While you do not have to communicate outside of your chosen booking platform, it will make the relay of information for your visit much easier to communicate with us directly via email.

Your booking is bound only by the full policy listed on the online travel *agency site with which you have used to make the booking and may not be subject to any of the additional information listed in these full terms and conditions. 

All bookings that are made using these online travel *agency sites have a 14-20% commission that is removed from the payout received by FSRE by the online travel *agency for your booking.

We are unable to refund any third-party commissions charged or withheld. If any condition is agreed upon for a partial refund, we are still unable to refund any third-party commissions charged or withheld. 

 

Online Guest Registration, Check-in & Security Deposits

All bookings are accepted on the basis that the utmost care and consideration are given to the premises and neighbouring occupiers by the holiday occupant.

Security deposits (by way of a completed digital Guest Registration Form and credit card pre-authorization) apply on all properties and an Online Guest Check-In/Guest Registration is required to be completed digitally in full and returned before occupation is allowed.

The online guest check-in is via a secure online portal where you are required to upload an image of your ID and your credit card. This portion of the booking process is non-negotiable and mandatory for all guests, regardless of how the booking was made.

  • ID required will need to be in the form of an officially issued photographic identification (Drivers’ Licence or Passport).
  • The credit card required is an image upload of the full face of the card showing the full digits and expiry of an acceptable card which is to be used for your security deposit. A card is required again regardless of already providing a card during the booking process.

These details will be emailed to you again before arrival and are available via the link included in confirmation emails, so that they can be completed early in the booking process.

FSRE reserves the right to process a Security Deposit listed on confirmation details specific to each property (between $500.00 – $4000.00) to the nominated card at any time before arrival or throughout the reservation through a Credit Card Pre-Authorization. The security deposit will vary between properties between the above-listed amount.

FSRE reserves the right to process a claim on the security deposit including but not limited to:

  • The property requires any abnormal or extra cleaning over & above the regular clean, including unwashed dishes & dishwasher having not emptied, BBQ not cleaned,
  • Any damage has occurred to the property that was not advised of earlier,
  • Requesting a service call out that is found to be not required,
  • The property is left unsecured resulting in any loss/damage,
  • Removal of excess rubbish left at the property,
  • Replacement or repair of furniture that has been moved from its original location,
  • Penalty for being in breach of tenancy and for overcrowding of the property,
  • Pets being in an unapproved property.

All properties have detailed inventory reports and have been photographed by the owner and the agent for layout purposes and further confirmation of fixtures & fittings within the premises. 

Linen & Self-Contained Accommodation 

FSRE specialise in holiday bookings for self-contained properties and do not offer daily service.

TSA, SISO, Nanook & JSA: properties are all provided including all linen and bedding. This includes sheets, pillowcases, towels, bathmats, tea towels. Specific bedding presentation may vary between properties (i.e. doonas vs hotel-style triple sheeting) and is unable to be requested or changed.

A small Bathroom & Kitchen Starter-Pack (consisting of washing detergent, chux, hotel-style toiletries or alternative toiletries & starter toilet paper) is supplied once on arrival. This is generally designed as a starter only for the first 1-2 nights of a visit.

Additional items to the Starter-Pack will not be replenished and will need to be purchased by the guest.

 

SCHA: properties do not provide linen (except where indicated). 

Guests are required to provide your own sheets, pillowcases, towels, bath mats, tea towels, kitchen and bathroom consumables (like sugar, tea, coffee, toilet paper and soap). Linen hire and additional cleaning services can be arranged at a nominal charge.

These details are provided again when booking.

 

Full Booking Terms & Conditions

Check-In Time Starts:    4:00 pm

Check-Out Time:   10:00 am

Please do not plan to arrive at the property earlier than this available time. Entry is via door codes, key lock boxes or key collection which will be provided on the day of arrival via either SMS or Email to the details listed on the booking.

  1. In providing booking services FSRE act as an agent for various property owners and does not accept or undertake any personal liability when acting in this capacity.
  2. Premises are let for holiday purposes only for the period stated in your confirmation/receipt by FSRE but may be subject to change as may be notified by the owner before the commencement of the booking. All advance deposits are accepted on behalf of the current owner; however, we will not accept responsibility for decisions, actions or arrangements taken by the current owners of the premises or any other body which is outside our control.
  3. FSRE reserve the right to cancel any booking should anything arise, which in our opinion renders the booking impractical. In either event, we shall notify you as soon as possible and do our best to arrange alternative accommodation or alternative suitable dates. If suitable alternatives cannot be arranged, all deposit monies paid will be refunded, but no other claim, right or action shall exist in or be made by either party.
  4. The owner will make every effort to ensure the property is available as advertised & booked. However, the owner reserves the right to make alterations to bookings due to unforeseen circumstances. FSRE does not accept responsibility for actions taken by property owners outside of our control and we, therefore, reserve the right to cancel bookings at the instruction of an owner. Bookings cancelled at the discretion of an owner will be notified to guests immediately. If possible, FSRE will secure alternative accommodation for the guest, however, if this is not possible all deposit monies paid will be refunded in full. Bookings are taken by the agent for the current owner. If the property is sold, we cannot guarantee that the new owner will continue to make the property available.
  5. The premises are available from 4.00 pm on the day of arrival and are to be vacated at 10.00 am on the day of departure. Do not plan to arrive at the property earlier than this available time – access will be denied. The purpose of these strict times is to allow the necessary time to clean the premises in times of high demand. Please consider your fellow incoming/outgoing holiday occupants. We cannot allow access for parking spaces or the storage of refrigerated items before arrival is advised as ready. PLEASE DO NOT ASK, AS WE DO NOT WISH TO OFFEND.
  6. Properties that do not allow pets: No pets are allowed in any property that is inside Kosciuszko National Park. This applies to all properties in Thredbo Village (TSA, SISO, Nanook). You cannot bring a pet into any NSW National Park or other land reserved or acquired under the National Parks and Wildlife Act 1974 (NPW Act). Assistance animals may accompany you providing that this is specified & confirmed with FSRE before booking and all documentation is provided to confirm that it is an assistance animal and that this information has also been verified by NSW National Parks. Bringing a pet into a property that is not authorised to accept a pet will result in immediate eviction of all occupants with No Refund and the possible charging of security deposits regardless of damages. 
  7. Properties that allow pets: If a JSA or SCHA property accepts pets, then this will be clearly listed in that property’s description.  If travelling with pets in a pet friendly property, guests must include this in the notes at the time of booking.
  8. The maximum number of persons permitted to occupy the booked premises will form part of the booking contract and will be nominated when you make your booking. Persons found occupying the premises over and above the number on the booking form will be charged automatically the full security deposit and an additional $500.00 a day for the term of the booking.
  9. Any & all damage, breakages, or losses to the property and/or furniture/furnishings are to be reported to FSRE and paid for immediately. Furniture is not to be moved or removed and all furnishings and equipment must be left on the premises as originally found.
  10. All accommodation is for residential purposes only. Functions and parties on the premises are strictly not allowed. Strata By-laws, Council Regulations and National Park Regulations must be always complied with. We ask that full consideration is given to other guests concerning noise, parking and any other issues that affect the peaceful enjoyment of others. FSRE reserves the right to terminate your holiday tenancy immediately if you cause nuisance or annoyance to neighbours or are found to be holding a function or party.
  11. Unless stated within the property description, all premises are fully self-contained including linen i.e. sheets, pillowcases, towels, bathmats, tea towels. A small Starter-Pack (being detergent/soap/toilet paper etc.) is supplied once on arrival. Additional items to the Starter-Pack will not be replenished and will need to be purchased by the guest.
  12. Lost Property: No responsibility is taken for a guest’s personal property left on the premises. Items left on the property will be kept for a maximum of 7 days and then disposed of.  If you require items to be returned to you, the cost of pre-paid postage + administration fee will be charged before postage. Items must be of a reasonable requestable size before locating or posting.
  13. With telephone, email or website bookings, any printed, written, or verbal description of our policies or the property by the agent or an employee is made in good faith. No responsibility for discrepancies in descriptions or specific property or location recommendations will be accepted. Please choose your property carefully using the information provided on our comprehensive websites (providing descriptions, photographs, videos or virtual tours). There is no provision to change properties on your arrival if you are unhappy with your choice. 
  14. Guests are responsible for the safekeeping and replacement of any accommodation keys, keycode reprogramming or garage door openers. Duplicate keys are not always available. Guests requiring an additional key or access assistance after office hours will be charged a service fee call out of $100.00 per hour. All keys or garage door openers are to be returned to their original location within the unit. The cost of any lost or replacement key’s, locks or locksmith callouts will be the responsibility of the occupant and charged per the security deposit.
  15. You are required to allow a repair and or service personnel to enter the premises to conduct any repair or service deemed necessary by FSRE. Such times of entering will be arranged prior where possible and will be between the hours of 8.30 am and 5:00 pm unless, in the opinion of FSRE, an emergency could exist or arise outside these times.
  16. Car parking spaces or carports are usually numbered and are limited strictly to the amount listed. Extra vehicles, trailers, boats etc. are not to be parked outside the property grounds and neighbouring property car spaces are not to be used. In Thredbo Village – the overnight car parking spaces will need to be used.
  17. In the event of renovation/building work being carried out in or near the holiday premises, such work is beyond our control, and we cannot accept responsibility for any disturbance, noise or inconvenience you may suffer as a result. No discount will be negotiated for any of the above.
  18. We operate in tourism areas that are considered regional in terms of census population. The repair and replacement of some items in properties cannot always be carried out promptly. The availability of relevant tradespeople cannot always be carried out promptly. No refunds or compensation will be issued for an item or appliance that becomes unusable throughout your visit. 
  19. FSRE participate in the Bad Books program and External Guest communication Register and log. The Bad Books register is a database of guests who have breached the Terms & Conditions of a booking, damaged property or indulged in inappropriate behaviour. By accepting this booking, you agree that FSRE can disclose this information to other accommodation providers that participate in Bad Books.
  20. FSRE will not accept rude or offensive language or behaviour at any time being used in conversation (in person, phone, or email) with our direct staff, our contractors, our cleaners, our maintenance team, or other guests. Any incidents of this nature may result in a cease in communication, immediate cancellation of bookings without resolution, eviction from your property or the full charge of the security deposit.
  21. FRSE keep an internal list of guests who have previously breached terms and conditions. FSRE reserves the right to refuse current & future service to anyone who has been listed under the internal list, Bad Books program, previously incurred security deposit charges, used offensive language or behaviour as listed in condition 19 or has been involved in litigation against FSRE, including but not limited to NSW Local Court or NSW Civil & Administrative Tribunal claims. FSRE reserves the right to cancel and refuse bookings under conditions listed above without notice.
  22. FSRE may refuse to accept any booking where we believe the booking is not in the best interests of the property owner or FSRE. We do not need at advise guests of the above and that future bookings may not be accepted by the same guest.
  23. All funds taken are held in a licenced real estate trust account under the Property and Stock Agents Act 2002. Those funds cannot be used for any purpose other than for that client and must be disbursed as the client directs. The client refers to the property owner in this instance.
  24. Bikes are not permitted to be brought into any property. Bikes are not permitted to be brought through any property. Bikes are not permitted to be stored on any balconies. If a booked property has an advertised and designated bike storage area/rack then this is permitted to be used, however, it will still be subject to cleanliness standards and any evidence or marks left by the unauthorised storage of bikes may cause the additional charge of a bond.
  25. FSRE are not responsible or bound by essential or non-essential services being provided to any property which are out of our control, or any partial or full interruptions to these services. This includes but is not limited to, internet service providers, satellite communications, TV & radio signals, mains power supply, mains water supply, mains water discolouration, or mains water boil water not fit for consumption alerts. 
  26. The regions where we operate are subject to extreme, dynamic, and fast changing weather conditions. FRSE is not bound by access to properties that may be affected by such weather conditions including but not limited to wind, fire, heavy rain or snow-covered roads and driveways, footpaths, access, or parking spaces. 
  27. FSRE accept no responsibility and will not be liable to you (or any third party) for any loss, cost, or damage (including loss of expected enjoyment or expectations) suffered directly or indirectly in connection with a holiday property booking. 
  28. Website photography, videography, virtual tours, headlines, description blurbs, advertisements or social media posts are solely descriptive and for the purpose of marketing and advertisement and any terms used are no indication of a guarantee of services or individual experiences and or expectations. FSRE accept no responsibility or guarantee services or individual experiences that may be implied via such marketing or advertisements, and they do not constitute implied conditions or a guarantee of suitability. 
  29. All properties are provided fit for purpose under conditions that FSRE deem to be within their control. FSRE are not responsible or bound by any circumstances out of our control or listed in any points of these Full Bookings Terms & Conditions.
  30. Any prices stated or quoted are only valid at the time of exact booking and do not guarantee or indicate future prices or availability of discounts. Prices are dynamic. This is not limited to supply and demand due to weather or events or property feature changes, renovations or increase/decrease of occupancy numbers.
  31. These terms and conditions may be varied at any time without notice.   Guests should always refer to our website for current terms and conditions. Terms and conditions are subject to change annually.

South Coast Holiday Accommodation

Fishing & Boating Policy:

  1. Dogs must not be left alone or unsupervised inside the holiday accommodation or anywhere outside the property at any time.
  2. Dogs are not permitted on the furniture (i.e. beds, sofa, & chairs for example)
  3. Please be respectful of the neighbours and prevent your dog from excessive barking.
  4. We do not provide any amenities for your pet. Dog owners must make their own sleeping arrangements for their pets (i.e. dog beds, cages, bowls leads and toys for example)
  5. You are responsible for the cleaning and removal of all dog excrement

Dog and Pet Policy:

  1. There is to be no cleaning of fish or boats at any SCHA properties. Any evidence of this at a property will result in additional cleaning fees being charged or bonds being withheld without notice.
  2. Not all properties have suitable boat parking. If you would like to bring a boat with you, you need to obtain the Agent’s approval at the time the booking is made.
  3. Noise: As the property is located in a residential area, we ask that guests and their visitors are considerate regarding boat related noise levels at all times. You must not make noise or use the premises in a way that will unreasonably interfere with the peace and comfort of the neighbours
  4. Boats and vehicles are to be stored inside the property boundary and be parked within the premises parking facilities/driveway as provided (there is to be no parking on the lawns).
  5. Throughout the region, the Council has provided public toilets, fish cleaning facilities, waste disposal bins (including dedicated fish waste disposal bins), and mains fresh water taps. There is ample parking at each site for vehicle and trailer parking. The local council has provided engine flush/boat washing facilities adjacent to the two launching areas in Bermagui – located:- near the eastern exit/entry of the Bermagui Harbour boat ramp, and Bermagui River boat ramp. (Bridge Street – parking area via two driveways).
